Kansas Right-to-Race Bill Approved to Shield Tracks from Disgruntled Neighbors

It's a classic scenario: unhappy neighbors move next to a racetrack and call for its closure due to noise complaints. While we've observed lawsuits and legal disputes in certain cases, this will no longer be a concern in Kansas. The state legislature has passed the Kansas Motorsports Venue Protection Act, granting civil immunity to 20 operational tracks in the state.
After a unanimous 122-0 vote in the Kansas House of Representatives earlier this week, the bill now awaits the signature of Governor Laura Kelly. The Specialty Equipment Manufacturers Association (SEMA) and Performance Racing Industry (PRI) are encouraging supporters to contact Governor Kelly, though approval seems highly likely at this point. It's rare to see such unanimous government agreement.
HB2416 specifically safeguards tracks that have been continuously operating without a break longer than four years. If enacted, neighbors who establish or purchase residential or business properties within five miles of these tracks after their development will be unable to file nuisance or property complaints. This law would protect historic facilities from disturbances caused by newcomers.
PRI reports that motorsports in Kansas generates over $743 million in annual revenue, in addition to more than $77 million in state and local taxes, while also supporting nearly 5,700 jobs. These significant figures likely caught the attention of lawmakers.
SEMA
Kansas is set to join North Carolina and Iowa as another state passing right-to-race legislation. SEMA’s website features a map of active relevant bills, including those in Oklahoma, Nebraska, Missouri, Tennessee, Kentucky, Georgia, South Carolina, West Virginia, Ohio, Michigan, and Wisconsin. SEMA and PRI are actively working on legislation to ensure the continued operation of racetracks, crucial for their member businesses.
